The K-4 US Family Visa is a nonimmigrant visa for children of K-3 visa holders who are unmarried and under the age of 21, allowing them to travel to the United States with their parent to await a Green Card and US resident status.
US Family Visa K-4. Advantages:
You can:
is permanently in the USA with your family;
travel freely within and outside the United States on short trips;
apply for a Work Permit by registering Form I-765 and engage in any employment activity;
study in the USA.
However, you cannot:
change your K-4 status to any other nonimmigrant status;
come to the United States if you have previously violated the Immigration Act.
Your K-4 status will be automatically canceled within 30 days of completing one of these points:
Rebuttal or Cancellation of Form I-130 – Petition for Alien Relative filed on your behalf;
Denial or cancellation of an immigrant visa application submitted by you;
Denial or cancellation of your application for permanent resident status;
Your K-3 parent’s divorce from a US citizen;
Your marriage or 21st birthday Important: Denying or canceling one of the above K-3 applications from your parent will automatically cancel your K-4 status.
Family Visa USA K-4 – Documents for registration
To obtain a K-4 visa, you must provide the following documents:
Two copies of completed Form DS-160 – Application for a Nonimmigrant Visa;
Two color photographs as for a passport on a white background of applicants for a K-3 and K-4 visa;
police clearance certificates for K-3 and K-4 visa applicants;
Birth certificates of K-3 and K-4 visa applicants;
Marriage certificate of the main applicant for a K-3 visa;
Divorce Certificates or Death Certificates, if held by the main K-3 applicant;
Medical examination;
Valid passports of K-3 and K-4 visa applicants
US Family Visa K-4 – Length of stay
A K-4 visa is valid for two years with entry and exit options, or until the applicant turns 21.
Renewal of status.
You can apply for an extension of your K-4 visa at the same time as your K-3 visa using Form I-539 – Requesting a Change or Renewal of Nonimmigrant Status 4 months before your visa expires. The visa is extended for two years.
